§ 1 – Conclusion of the contract
The contract is concluded by the registration of the participant and the registration confirmation of the organizer.
If the organizer does not respond to the participant’s registration within 14 days, the participant is no longer bound by his/her registration.
§ 2 – Service, Participation Fee, Payment, Default of Payment
- With the conclusion of the contract according to § 1, the participant undertakes to pay the participation fee. The participation fee entitles you to participate in the live role-playing game.
- Payment of the participation fee is generally made in advance by bank transfer.
- In the event of a delay in payment of more than 14 days after the request for payment, the reservation will be invalidated and the place will be given to another participant. The receipt of payment on the organizer’s account is decisive.
- In the case of registrations in the name and on behalf of a third party, the applicant shall be jointly and severally liable for the latter’s liabilities arising from this obligation.
§ 3 – Withdrawal, non-acceptance of registration, exclusion from the event
- All persons with unlimited legal capacity are eligible to participate. If the rules are violated, this right to participate can be revoked.
- The number of participants is limited. Participation places are not transferable. The naming of a replacement participant requires the written consent of the organizer.
- If the participant withdraws after conclusion of the contract in accordance with § 1 – regardless of the point in time – a cancellation fee will be due, depending on the withdrawal date. Up to 30 days before the start of the event, 50% of the participant fee From the 29th day before the start of the event, 100% of the participant fee.
- The organizer reserves the right to exclude participants from the event in advance of the event without giving reasons in return for a refund of the participant fee already paid.
- If the event is cancelled, contributions already paid will be refunded; there are no further claims.
§ 4 – Liability
- The organizer assumes only limited liability for property damage and personal injury, with the exception of evidence of gross negligence or intent on the part of the organizer, its legal representative or its vicarious agents. Otherwise, the person responsible is liable.
- Compensation for damages arising from positive breach of contract, negligence in concluding the contract and unlawful acts is excluded unless the organizer, its legal representative or its vicarious agents have acted intentionally or with gross negligence.
- Claims for damages arising from impossibility of performance, breach of duty and delay are limited to compensation for foreseeable damage in the case of minor negligence.
- The organizer is entitled to be responsible for cleanliness violations within the meaning of the house rules at the location of the event or for damages that are subsequently calculated by the homeowner, including subsequent charges. If locations are not abandoned properly, the additional costs incurred by the organizer will be distributed and charged to the people assigned to them.
- The participant undertakes to fully follow the rules of location use. Violations can lead to exclusion. Any costs incurred must be borne by the person responsible.
§ 5 – Rules
By registering, the participant accepts the system of rules specified by the organizer as binding for the game. The project management is entitled to make binding rule changes even after the contract has been concluded.
§ 6 – Security
- The participant assures that he/she is able to take part in the event with sufficient consideration of the expected physical, mental and emotional stress. In case of doubt, the organizer can provide further information.
- The participant is obliged to regularly check the rented equipment for safety before and during the event. If they do not comply with the safety regulations or no longer comply with them, he/she must remove them from use independently. Objects in question may no longer be used in the game. Violations can lead to exclusion.
- Your own equipment may not be brought to the event without the consent of the organizer.
- The participant undertakes to avoid risks to themselves, other participants and the environment that go beyond the normal risk of live role play. In particular, this includes entering cordoned-off areas, lighting open fires, playing action-packed games in dark or unclear areas (stairs, passageways, etc.), as well as careless movement on the event site.
- The consumption of alcohol is expressly prohibited during the event, unless agreed upon on site.
- Anyone who has taken medication during the event that makes it illegal to drive a vehicle on public roads must strictly refrain from physically dangerous actions. Violations will result in immediate exclusion from the game.
- The instructions of the organizer, his legal representative and his vicarious agents (e.g. game management) must be followed.
- Participants who violate the safety regulations or endanger other participants or who do not follow the instructions of the organizer, his legal representative or his vicarious agents can be excluded from the event without the organizer having to refund the participant fee (even pro rata). ) is obliged.
- Possession of drugs (intoxicants, hallucinogens) leads to immediate exclusion from the event, without the organizer being obliged to refund the participation fee (not even in part).
§ 7 – Copyright in recordings
- All rights to sound, film and video recordings made by the organizer remain reserved to the organizer. The organizer is entitled to record the entire event or parts of it and to use these recordings for the purposes of scientific evaluation, documentation and self-promotion.
- All rights to the listed action, as well as the ensemble of terms, proper names and non-player characters used by the organizer remain reserved to the organizer.
- Image and sound recordings by participants are only permitted for private purposes.
- Any public performance, transmission or reproduction of recordings, even after editing, is only permitted with the written consent of the organizer.
- With the conclusion of the contract in accordance with § 1, the participant agrees that sound, film and video recordings made may be passed on to a college or university to evaluate the educational processes for the purpose of scientific evaluation of the project. The organizer undertakes to anonymize this media.
§ 8 – Data protection declaration
- The participant agrees that his/her data contained in the contract offer will be kept in an automated participant file from the start of registration. This data will not be passed on.
- Voluntarily provided data on the participant’s health status and nutritional information will be treated confidentially and will not be passed on to third parties.
§ 9 – Miscellaneous
- There is no entitlement to gender-segregated accommodation.
- All additional agreements and changes must be in writing. You must meet with authorized representatives of the organizer.
- If one or more provisions of these General Terms and Conditions of Business and Participation are or become ineffective, this does not affect the validity of the contract and the remaining provisions. In the event that individual provisions are invalid, the regulation that comes economically closest to the one originally intended and is legally permissible applies.
